Museum Traveller provides a subscription service that allows our members to access entertainment content (“Museum Traveller content") over the Internet on certain Internet-connected TV's, computers, tablets, and other devices (“Museum Traveller compatible devices”).

You have accepted these Terms of Use, which govern your use of our service.

As used in these Terms of Use, “Museum Traveller service", "our service" or "the service" means the service provided by Museum Traveller for discovering and accessing Museum Traveller content, including all features and functionalities, website, and user interfaces, as well as all content and software associated with our service.

Your use of Museum Traveller's service is subject to these Terms of Use, our Privacy Policy and any other terms, conditions, policies or guidelines that may be applicable to specific areas of our service.

In these Terms of Use, “Museum Traveller", "we", "us" or "our" refers to Museum Traveller LLC., a Delaware limited liability company. The term “you” refers to the person who uses our service and/or website.

1. Use of our Service

Subject to these Terms of Use, we grant you a limited, non-exclusive, non-sublicensable, revocable and nontransferable license to access and use our service.

Use of our service requires compatible devices, Internet access (fees may apply) and certain software (fees may apply);

2. Registration and Accounts

You must register for an account and provide certain information about yourself in order to use our service.

You are responsible for maintaining the confidentiality of your account password, and you agree to accept responsibility for all activities that occur under your account. If you have reason to believe that your account is no longer secure, you must immediately notify Museum Traveller by contacting us at support@museumtraveller.com.

3. Subscription Plans and Fees

Museum Traveller offers various subscription plans, which may change from time to time. The benefits associated with each subscription plan are described on our website or within the Museum Traveller service.

We reserve the right to modify, terminate or otherwise amend our offered subscription plans at any time.

Paid subscriptions are non-refundable and we do not provide refunds or credits for any partial monthly periods.

Prices for our subscription plans are subject to change at any time.

4. Free Trials

Museum Traveller may, from time to time, offer free trials of our paid subscription plans. Free trials are intended to allow new and/or potential subscribers to try our service before committing to a paid subscription.

Free trial eligibility is determined by Museum Traveller in its sole discretion and we may limit eligibility or duration to prevent abuse. We reserve the right to revoke a free trial at any time and without notice.

5. Payment Methods

Museum Traveller accepts various payment methods, which may change from time to time. You agree to pay all fees associated with your account and subscription plan, as well as any taxes that may be applicable to your use of our service.

6. Cancellation and Termination

You may cancel your subscription at any time by contacting us at support@museumtraveller.com or through the cancellation link in your account settings. If you cancel, your access to our service will continue until the end of your then-current subscription period, and you will be responsible for paying any amounts due for your use of the service through the end of such period.

Museum Traveller may terminate your access to all or any part of our service at any time, with or without cause or notice.

7. Modifications to our Service

We reserve the right to modify or discontinue, temporarily or permanently, all or any part of our service with or without notice. You agree that Museum Traveller will not be liable to you for any modification, suspension or discontinuance of our service.

8. Content and License

All content made available through our service, including but not limited to video, audio, text, images, software and other materials (“Museum Traveller content"), is owned by or licensed to Museum Traveller.

Except as specifically provided in these Terms of Use or elsewhere on our website or within the Museum Traveller service, no Museum Traveller content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted or sold in any form or by any means.

You may not reverse engineer our software or attempt to access it in a manner that exceeds the limited rights granted to you under these Terms of Use.

Museum Traveller grants you a limited, non-exclusive, revocable, non-transferable license to access and view Museum Traveller content through our service. This license is for your personal, non-commercial use only.

9. User Generated Content

Museum Traveller may provide areas on our website and within the Museum Traveller service for you to post content and materials (“User Generated Content").

You are solely responsible for any User Generated Content that you post, upload or otherwise make available through our service.

You understand and agree that we may, but are not obligated to, review, monitor, or remove User Generated Content, at our sole discretion and at any time and for any reason, with or without notice to you.

10. Third Party Sites

Our service may contain links to websites or other online services that are operated and maintained by third parties and that are not under the control of or affiliated with Museum Traveller.

We are not responsible for the content, accuracy or opinions expressed in such third party sites, and these sites are not investigated, monitored or checked for accuracy or completeness by us.

Inclusion of any linked site on our website or within the Museum Traveller service does not imply approval or endorsement of the linked site by us.

If you decide to access any of the third party sites linked to our website or service, you do so entirely at your own risk and subject to the terms and conditions of use for such sites.

MUSEUM TRAVELLER DOES NOT GUARANTEE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO OUR SERVICE. THE OPERATION OF OUR SERVICE MAY BE AFFECTED BY NUMEROUS FACTORS OUTSIDE OF OUR CONTROL.

WE CANNOT AND DO NOT GUARANTEE THAT ANY CONTENT MADE AVAILABLE FOR DOWNLOADING FROM OUR SERVICE WILL BE FREE OF VIRUSES OR OTHER DESTRUCTIVE CODE.

YOU ARE RESPONSIBLE FOR TAKING ALL PRECAUTIONS YOU BELIEVE NECESSARY OR ADVISABLE TO PROTECT YOU AGAINST ANY CLAIM, DAMAGE, LOSS OR HAZARD THAT MAY ARISE BY VIRTUE OF YOUR USE OF OUR SERVICE.

The failure of Museum Traveller to exercise or enforce any right or provision of these Terms of Use will not constitute a waiver of such right or provision.

If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the court shall give effect to the provisions of these Terms of Use that are legally enforceable and consistent with the original intent of Museum Traveller, to the fullest extent permitted by law.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with our service or these Terms of Use must be filed within one (1) year after such claim or cause of action arose, or be forever banned.

These Terms of Use and your use of our service will not create any joint venture, partnership, employment or agency relationship between you and Museum Traveller.

You may not assign these Terms of Use or any of your rights or obligations under these Terms of Use without our prior written consent. We may fully delegate, assign or transfer these Terms of Use or any right or obligation under these Terms of Use.

Museum Traveller and its logos are trademarks of Museum Traveller, and may not be copied, imitated or used, in whole or in part without our prior written permission. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of Museum Traveller, and may not be copied, imitated or used, in whole or in part without our prior written permission.

All other trademarks, registered trademarks, product names and company names or logos mentioned on our service are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by us.

The software underlying our service (the “Software”) is subject to United States export controls. No Software may be downloaded from our service or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.

These Terms of Use constitute the entire and exclusive understanding and agreement between Museum Traveller and you regarding our service, content made available through our service and any services purchased or obtained through our service, and these Terms of Use supersede and replace any previous or contemporaneous agreements or understandings, written or oral, regarding such subject matters. If for any reason a court of competent jurisdiction finds any provision of these Terms of Use invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms of Use will remain in full force and effect.
